Dahlia Plant Sale Terms and Conditions

Terms of Sale – Dahlia Plants 

1. Sales & Pick Up

1.1 Unless otherwise stated each listing is for one dahlia plant grown from a cutting. Each plant will be in a 100mm square pot and be sun hardened at time of pickup. Plants may vary in size. 

1.2 All plants are sold for pick up only at the specified time and location— we will not ship plants from this sale. We do not accept International orders. 

1.3 The sale will occur on our website ahead of the pickup date. It will open on Wednesday 29 October 2025 at 7pm AEDT. We reserve the right to refund any order placed before this time.

1.4 Item purchase limits may be implemented. These may be included in the listing description. We reserve the right to refund any order, in full or in part, that exceeds those limits. 

1.4.1 For Serenade Cultivars the purchase limit is one (1) of each cultivar, per household, before 7.30pm and three (3) of each cultivar after 7.30pm until Sold Out.

1.4.2 For all other cultivars the purchase limit is two (2) of each cultivar, per houeshold, before 7.30pm and four (4) of each cultivar after 7.30pm until Sold Out.

1.5 Stock is not reserved in your cart. Your order is not guaranteed until payment is made and you receive an email confirmation. 

1.6 While every effort is made to ensure accurate stock levels in the event of an error, or other reason that means we are unable to fulfil your order, you will be notified immediately by email.

1.7 Orders must be collected by the agreed date:

For 2025 the collection details are: Sunday 9 November from 10am to 2pm from Longwarry Town Hall  14 Kennedy Street, Longwarry 3816

1.8 If your order is not collected on the arranged pickup date without prior notice or agreement, a restocking fee of $10 per order will apply, and the plants may be resold.

1.9 You may be required to show your Order Confirmation email to collect your order. If you wish someone else to pickup your order forward your order confirmation to them so they can present it at pickup. We do not accept responsibility for giving someone your allocated plants where they show us an order confirmation - so be careful who you share it with!

2. Condition of Plants

2.1 All plants are sold “as is”.

2.2 You are encouraged to inspect your plants carefully at pickup. Any issues or concerns must be raised at the time of collection. Removing the plant from the premises will be deemed to be an acceptance of its condition. 

2.3 After you leave, we cannot accept claims for damage, condition, or suitability. While care is taken to propagate healthy stock we cannot guarantee that any plant does not have gall, virus, or any other pest or disease.

2.4 While all care is taken to ensure accuracy of plant labels we cannot guarantee that all are correct. If you believe a plant is mislabelled please contact us for a resolution that may include a refund, or replacement by tuber of the relevant cultivar the following season. 

3. Returns & Refunds

3.1 If a refund is agreed payment will be made to the original purchase method for the order. 

3.2 Choose carefully as change-of-mind returns are not accepted.

4. Care & Responsibility

4.1 Once collected, the plants become your responsibility. We can’t be responsible for plant health after pickup due to variations in care, soil, water, and climate conditions. You will receive a basic care guide for your plants. 

4.2 We make every effort to provide healthy plants and accurate descriptions. However, as living products, plants may vary in colour, form, and growth.

5. Intellectual Property

5.1 All intellectual property rights, including but not limited to trademarks, logos, and website content, belong to us or our licensors. You may not use, reproduce, or distribute any of our intellectual property without our prior written consent.

5.2 You must not knowingly export, participate in export, or arrange the export of Serenade Dahlia cultivars from Australia

6. Updates to Terms

6.1 We may update these Terms of Sale from time to time. The version published on our website at the time of your order will apply to that purchase.

7. Whole Agreement and Severability

7.1 These Terms of Sale constitute the entire agreement between you and us in relation to the purchase of our plants and supersede any prior understanding, arrangement, or agreement, whether oral or written.

7.2 If any provision of these Terms is found to be invalid, unlawful, or unenforceable for any reason, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect.

8. Governing Law and Jurisdiction

8.1 This Agreement shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia. 

8.2 These terms and conditions are in addition to and do not displace any rights or remedies available to you as a consumer under the Australian Consumer Law (ACL).

8.3 Nothing in these terms and conditions is intended to exclude, restrict, or modify any rights or remedies that you may have under the ACL that cannot be lawfully excluded, restricted, or modified.

By completing the purchase, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you do not agree with any provision of this Agreement, please refrain from placing an order with us.
